This WeWork Contest (the “Contest”) is intended for viewing and participation only in the following markets and for brokers representing clients in the following markets:: Atlanta, GA; Boston, MA; Chicago, IL; Philadelphia, PA; Los Angeles, CA; Orange County, CA; Miami, FL; San Francisco, CA; and Greater Washington, D.C. Metro Area (the “Contest Markets”). The Contest shall only be construed and evaluated according to U.S. law. Do not enter this Contest if you are not an eligible licensed commercial real estate broker who meets the Eligibility Restrictions noted below in these Official Rules. Any broker who represents any WeWork building under an agency agreement is not eligible to participate in this Contest. Contest begins May 18, 2021 at 9:00 a.m. EST and ends July 31, 2021 at 11:59 p.m. EST (the “Contest Period”).
ELIGIBILITY RESTRICTIONS
You may participate in this Contest only if you meet ALL of the following conditions:
The Contest is subject to all applicable federal, state, provincial/territorial and local laws and regulations, and is void in any other jurisdiction where prohibited or restricted by law.
HOW TO PARTICIPATE
To participate in the Contest, during the Contest Period eligible brokers will need to schedule a tour, either virtually or in-person, with a PNM at any WeWork location located within the Contest Markets. The tour must be completed with a member of the WeWork Leasing team for a space measuring over 1,500 square feet. Only the first tour with each PNM is eligible for the Contest. There are three (3) ways to schedule a tour: (i) go to wework.com and fill out the form to schedule a tour for your PNM; (ii) sign up for a tour for your PNM through the official Contest landing page located at wework.com/info/2021-broker-tour-incentive; or (iii) schedule a tour for your PNM directly through our team via email at one of the emails listed on the website. For each qualifying tour that is completed, you will earn one (1) point (each, a “Point”).
Points not earned in compliance with these Official Rules may be disqualified, in Sponsor’s (as defined in the Sponsor Section below) sole discretion. Points will be deemed to have been earned by the participant who completes the qualifying tour. Points that have been generated by a macro, bot or any other automated means will be deemed void. Participants may not participate in the Contest with multiple email addresses nor may participants use any other device or artifice to register multiple times or as multiple registrants.
WINNER DETERMINATION
Following the conclusion of the Contest Period, the participant who receives the most Points in each Contest Market will be eligible to win one of the Grand Prizes (as defined below). In the event of a tie for any Grand Prize, the participant who achieves the final point first shall be the winner. Winner determination will be conducted on or about August 16, 2021.
PRIZES
Nine Prizes (limit one (1) prize per person):
The Total ARV of all prizes: $22,500 USD. ARV is as of date of printing these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.
Taxes, as applicable, related to the Grand Prizes are the responsibility of winner. Prizes will be treated as taxable income for participants who received them, and winners shall be required to provide a W-9 form and the Grand Prizes will be reported on applicable tax forms (Form 1099 in the U.S.). Failure to provide the required tax form within 30 days of the announcement will result in disqualification.
Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes are non-transferable and no substitutes or cash redemptions will be made, except as provided herein. In the event any prize becomes unavailable, Sponsor reserves the right to award a prize of equal or greater value. All prize details are at Sponsor’s sole discretion.
WINNER NOTIFICATION
Potential winners will be notified via email (with instructions on how to claim the applicable prize) to the winner’s email account on or about August 16, 2021. It is the potential winner’s responsibility within five (5) business days of attempted notification to provide a valid shipping address and telephone number to receive the applicable prize or prize will be forfeited.
The names of potential winners will be posted by Sponsor on the official Content landing page following the end of the Contest, on or about August 20, 2021.
In the event of noncompliance with the Official Rules, if a potential winner cannot be contacted, or if a prize or prize notification is returned as unclaimed or undeliverable, potential winner will forfeit the prize. Unclaimed prizes may not be awarded. Each winner will be required to sign and return (i) an affidavit of eligibility and (ii) a liability release of participant, except where prohibited.
CONDITIONS
By participating, each participant grants to Sponsor and its licensee, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to publish, reproduce, distribute, display, exhibit, exploit, perform, edit, modify, adapt, create derivatives of, and otherwise use all content associated with the Contest, together with any other material, and the name, Instagram user name, city and state/province/territory of residence, voice, image and/or likeness of participant, in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, participant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade.
By participating, each participant further agrees: (i) to abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects; (ii) to release, discharge and hold harmless Sponsor and each of their respective parent companies, subsidiaries, affiliates, retailers, sales representatives, distributors, and advertising and promotion agencies, as well as the directors, officers, employees and agents of all of the foregoing parties (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from participant’s participation in the Contest or the acceptance or use of a prize; and (iii) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages that could arise out of this Contest. Released Parties are not responsible for (i) lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled materials; (ii) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications; (iii) failed computer, satellite, telephone or cable transmissions, lines, or technical failure; (iv) jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (v) other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Contest, including without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Points, the announcement of the prizes or in any Contest-related materials; (vi) any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest; (vii) injury or damage to any person’s computer or other device related to or resulting from participating in this Contest; or (viii) any error, omission, interruption, deletion, theft, or disruption or unauthorized access to, or alteration of, entries. Persons who tamper with or abuse any aspect of the Contest or Sponsor website or social media account, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Points will be void. Points that have been tampered with are void. Sponsor reserves the right to disqualify any participant that Sponsor determines, in its sole discretion, has threatened the operation of this Contest or violates the Official Rules. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and if terminated, at its discretion, select a winner or winners based on the number of Points earned to the date from all eligible, non-suspect participants prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Information used in connection with this Contest will be used in accordance with Sponsor’s Privacy Policy, available at https://www.wework.com/legal/global-privacy-policy.
DISPUTES AND GOVERNING LAW
As a condition of participating, participants agree that, to the fullest extent permitted by applicable law any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By participating, each participant further agrees that, to the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules. By participating, participants also consent to the jurisdiction and venue of the federal, state and local courts for New York County, New York. If any provision of these Official Rules is determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.
