Gifts Made at WeWork Social Media Sweepstakes Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  This Sweepstakes is intended for viewing and participation in the 50 United States and the District of Columbia (“U.S”) only and shall only be construed and evaluated according to U.S. law.  Do not enter this Sweepstakes if you are not (i) a legal resident of the U.S. age 21 or older, and (ii) located in the U.S. at the time of entry.  Sweepstakes begins Wednesday, December 12, 2024, at 10am EST and ends Thursday, December 13, 2024, at 10am EST (the “Sweepstakes Period”).

HOW TO ENTER

To enter the Gifts Made at WeWork Sweepstakes (the “Sweepstakes”), during the Sweepstakes Period, (i) follow WeWork (“Sponsor”) at @WeWork on Instagram, (ii) find the post about the Sweepstakes on the @WeWork Profile Page and “like” the post, and (iii) comment on the post by tagging one (1) friend in the comments section and naming which product from our gift guide is on your holiday wish list. Completing the above will count as one (1) entry. To follow Sponsor on Instagram and enter the Sweepstakes, you must have or create a valid, non-private Instagram account.  Creating and maintaining an Instagram account is free.  When you join Instagram, you are indicating that you have read and agree to accept the Terms of Use available at https://help.instagram.com/581066165581870. All entries must be received by Thursday, December 13, 2024, at 10am EST . 

Entries will be deemed to have been submitted by the authorized Instagram account holder associated with the username used to enter via Instagram.  The authorized account holder is defined as the natural person who is assigned to a username by Instagram.  You must enter using only an Instagram account subscribed to and registered in your name.  The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the user name/Instagram account associated with the winning entry.  Entries that have been generated by a script, macro, bot or any other automated means will be deemed void.  Participants may not enter the Sweepstakes with multiple email addresses/Instagram accounts nor may participants use any other device or artifice to register multiple times or as multiple registrants. Entries not in compliance with these Official Rules may be disqualified, in Sponsor’s sole discretion.  Any participant who attempts to enter with multiple Instagram accounts under multiple identities will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion.  Proof of submission of an entry shall not be deemed proof of receipt by the Sponsor.

Entries must be in keeping with Sponsor’s image and not contain, as determined by Sponsor, in its sole discretion, any content that:

  • is offensive or inappropriate for any reason; is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;

  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;

  • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;  

  • defames, misrepresents or contains disparaging remarks about other people or companies;

  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;

  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;

  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission; 

  • contains look-alikes of celebrities or other public or private figures, living or dead;

  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or

  • violates any law.

ELIGIBILITY RESTRICTIONS

This Sweepstakes is open only to individuals who are (i) legal residents of the U.S. age 21 and older, and (ii) located in the U.S. at the time of entry.  Employees, officers and directors of Sponsor, its parents, subsidiaries, affiliated companies, retailers, distributors, and advertising and promotion agencies, and each of their respective IRS dependents, immediate family members (defined as spouse, parent, child, sibling and their respective spouses) and individuals residing in their same household are not eligible to enter or win.  Sweepstakes is subject to all applicable federal, state and local laws and regulations.  Void where prohibited.

WINNER SELECTION

One (1) potential winner will be selected in a random drawing on or about Thursday, December 13, 2024, from among all eligible entries received.  Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.

PRIZE

Prizes:  One (1) winner will receive one (1) Gift box with the following products: (i) Tooletries Scrubber set valued at $38.50 USD; (ii) Versed Hero set valued at $57.85 USD; (iii) Loisa Sofrito jar valued at $12.00 USD; (iv) LARQ PureVis 2 bottle valued at $99.00 USD (v) myPanier Eiffel chocolates valued at $26.95 USD;  (vi) Skeem Balsam incense valued at $29.50 USD; (vii) Bird And Bear Coffee - Peek-a-boo espresso valued at $17.00 USD;  (viii) ONDO - 4-pack socks valued at $45.50 USD; and (ix) one (1) WeWork baseball cap valued at $25.00 USD. Limit one (1) prize per person/authorized Instagram account winner.  Total ARV of all prizes: $350.00.  ARV is as of date of printing these Official Rules.  The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.  All taxes on prizes are the sole responsibility of winner.  Prize is awarded “as is” with no warranty or guarantee, either express or implied.  Prizes are non-transferable and no substitutes or cash redemptions will be made, except as provided herein.  In the event any prize becomes unavailable, Sponsor reserves the right to award a prize of equal or greater value.  All prize details are at Sponsor’s sole discretion.

WINNER NOTIFICATION

Potential winner will be notified via direct message (with instructions on how to claim the prize) to the winner’s Instagram account.  Potential winner may also will be notified by @WeWork via a comment on their winning post.  It is the potential winner’s responsibility within four (4) days of attempted notification to provide a valid shipping address and telephone number to receive the prize or prize will be forfeited.  In the event of noncompliance with the Official Rules, if a potential winner cannot be contacted, or if a prize or prize notification is returned as unclaimed or undeliverable, potential winner will forfeit the prize.  Unclaimed prizes may not be awarded.  Sponsor is not responsible for any change in Instagram account information, email, mailing address and/or telephone number of participants. The winner will be required to sign and return an affidavit of eligibility and a liability and publicity release, except where prohibited, within four (4) days of notification or prize will be forfeited.  By accepting a prize, winner agrees to the use of their name and/or likeness for advertising and promotional purposes without additional compensation, except where prohibited by law. 

CONDITIONS

By participating, each entrant agrees: (i) to abide by these Official Rules and decisions of the judges, which shall be final and binding in all respects; (ii) to release, discharge and hold harmless Sponsor and each of their respective parent company, subsidiaries, affiliates, retailers, sales representatives, distributors, advertising and promotion agencies, as well as directors, officers, employees and agents of all of the foregoing parties (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or the acceptance or use of a prize; and (iii) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages that could arise out of this Sweepstakes.  Released Parties are not responsible for (i) lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, comments or messages; (ii) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications; (iii) failed computer, satellite, telephone or cable transmissions, lines, or technical failure; (iv) jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (v) other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials; (vi) any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes; (vii) injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes; or (viii) any error, omission, interruption, deletion, theft, or disruption or unauthorized access to, or alteration of, entries.  Persons who tamper with or abuse any aspect of the Sweepstakes or any Sponsor website or social media account, or Instagram, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void.  Entries that have been tampered with are void.  Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, has threatened the operation of this Sweepstakes or violates the Official Rules.  Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and if terminated, at its discretion, select a winner or winners at random from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.  Information used in connection with this Sweepstakes will be used in accordance with Sponsor’s Privacy Policy, available at  https://www.wework.com/legal/global-privacy-policy.  

WINNER LIST

The name of the winner will be posted by @WeWork on Instagram Stories following the end of the Sweepstakes, on or about December 14, 2024.

DISPUTES AND GOVERNING LAW

As a condition of participating, entrants agree: (a) all causes of action shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.  By participating, each entrant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules.  By entering, participants also consent to the jurisdiction and venue of the federal, state and local courts for New York County, New York.  If any provision of these Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.
