Event Terms and Conditions
I acknowledge We Work Management LLC and its affiliates (collectively, “WeWork”) has granted me a revocable license to the applicable event, whether hosted in-person or virtually (the “Event”). I acknowledge that I will follow all instructions and/guidelines issued by WeWork at all times during the Event. WeWork reserves the right to revoke the license with or without cause. In particular, the license may be withdrawn to any person whose conduct is deemed to be disorderly, who uses abusive language, fails to comply with these terms, any physical or information security policies or any terms and/or rules imposed by the Event premises or by WeWork, as applicable.
For in-person events, searching is a condition of entry to the Event at the WeWork’s sole discretion. I acknowledge I and my belongings may be searched on entry to the Event. I consent to such searches and waive any related claims that may arise. By electing not to consent to such searches, I acknowledge that I may be denied entry to the Event without refund or other compensation. Under certain facility rules, certain items may not be brought into the Event premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles and containers. WeWork reserves the right to confiscate any item which in the opinion of the WeWork may cause danger or disruption, be a health and safety risk, not be suitable to be taken into the Event or is one of the items not permitted in the Event premises as detailed in these Terms and Conditions.
I acknowledge and understand that any content provided in an Event is for general informational or educational purposes only and is provided on an AS IS basis. WeWork makes no representations or warranties, of any kind whatsoever, express or implied, as to the completeness, accuracy, usefulness or timeliness of information presented and WeWork shall have no liability for any error or omissions. Under no circumstances should any content provided herein be construed as professional, investment, legal, tax or accounting advice by WeWork and the statements within the content should not be used without the advice of a third party professional with expertise in the relevant field. The views, information, or opinions expressed during the Event are solely those of the individuals involved and do not necessarily represent those of WeWork or of its employees. WeWork assumes no responsibility or liability for any errors or omissions in the content provided in an Event.
I give my irrevocable consent and grant WeWork and its affiliates the right to utilize my name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, including without limitation for commercial or promotional purposes, without further review or authorization from, or compensation to, me or anyone acting on my behalf. I acknowledge that WeWork or its affiliates shall own the copyright in these audio, video, and photographs.
In the case of Events resulting in physical activities such as guided wellness events (including, but not limited to, yoga, strength training, pilates, or boxing):
Acknowledgement. I acknowledge that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me, if any,; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these risks may result in serious injury or death to myself and/or others. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity under direction of WeWork. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others. In an emergency, I acknowledge that I am solely responsible for all medical and other costs arising out of bodily injury or any loss sustained through participation in the Event. I authorize the Event staff to secure any licensed hospital, physician and/or medical personnel for any treatment deemed necessary for my immediate medical care.
Release. In consideration of both the above mentioned risks and hazards and the fact that I am willingly and voluntarily participating in the activities offered by WeWork, I, the undersigned, hereby release WeWork and its officers, agents and employees (“Covered Parties”) from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
Indemnification. I recognize that there is risk involved in the types of activities offered by WeWork. I accept any financial responsibility for any injury that I may cause either to myself or to any other member or other individual due to my negligence or misconduct. Should the parties above, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless WeWork, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligence, willful misconduct or omission while participating in activities offered by WeWork.
No refund or other remedy will be provided under any circumstances, including, without limitation, if the holder is ejected or refused entry due to disorderly conduct or failure to comply with these terms, any security policies or any terms and/or rules imposed by the Event premises or by WeWork, as applicable, and I will not be entitled to any damages, including, but not limited to consequential, incidental or exemplary damages. All ticket purchases are non-transferrable. If I do not receive a confirmation (in the form of a confirmation page or email) after submitting payment information, or if I experience an error message or service interruption after submitting payment information, I acknowledge my responsibility to confirm with the event organizer whether or not my order has been placed. I acknowledge only I may be aware of any problems that may occur during the purchase process. I acknowledge Covered Parties will not be responsible for losses (monetary or otherwise) if I assume that an order was not placed because I failed to receive confirmation.
WeWork may provide information to you about certain third-party service providers (each, a “Provider”). I acknowledge I am subject to the rules, regulations, terms of service, and/or related agreements of the Event premises and of any and all such Providers. You acknowledge and agree that WeWork is not responsible for any third-party products or services offered by any Provider (“Services”). The Services are made available exclusively by each Provider, and WeWork is not responsible for the performance of the Services and does not make any representations about the Services. I acknowledge that WeWork accepts no responsibility for any damage and/or delay due to a Provider’s cancellations, shortages, labor disputes, machinery breakdown as well as any quarantine, government restraints, inclement weather or force majeure events beyond WeWorks’ control. If you have any disputes or issues regarding a Service obtained from a Provider, you must contact the Provider directly. A Provider may provide goods or services that require a Provider to have a regulatory authorization or license. WeWork does not verify, validate, or collect evidence of any regulatory information about any Provider. You should make whatever investigation you deem necessary before purchasing any offering from a Provider. Each Provider is solely responsible for the accuracy, care and quality of the Services being provided. WeWork shall not be responsible for any Provider's failure to comply with applicable federal, state and local law.
Except in the case of gross negligence by WeWork, I agree that WeWork’s liability for loss or damage to me shall be limited to the price I paid for (a) my ticket, or (b) the services I received at the Event. I ACKNOWLEDGE I WILL NOT BE ENTITLED TO CONSEQUENTIAL, INCIDENTAL, OR EXEMPLARY DAMAGES OF ANY KIND.
I acknowledge that I am above the age of majority of the country that the Event is being held and agree to all these Terms and Conditions prior to entering the Event.
WeWork may revise these terms and conditions, in our sole discretion, at any time and without prior notice to you, by updating this posted version of these Terms and Conditions. You should review this website for changes to these Terms and Conditions. Any changes are effective upon posting to this website. If you disagree with any changes, your sole and exclusive remedy is to terminate your relationship with WeWork. Your continued use after notice of a change has been posted will constitute your acceptance of those changes.
These terms and conditions shall be governed by New York law, without regard to conflicts of laws provisions. By participating in this Event, you agree that any dispute or litigation arising from or relating to this Event shall be determined by binding arbitration only in New York, NY, by and under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, WeWork may seek equitable relief in any court of competent jurisdiction.
